Terms of Service

1. Agreement

By using SellPic ("the Service"), you agree to these terms. If you don't agree, please don't use our service. The Service is operated by Rudolf Haas ("we", "us").

2. The Service

SellPic is an AI-powered tool that generates product images optimized for e-commerce marketplaces. You upload product photos, and our AI creates professional listing images.

3. Accounts

• You must provide a valid email address to create an account.
• You are responsible for maintaining the security of your account.
• You must be at least 16 years old to use the Service.
• One person may not maintain more than one free account.

4. Credits & Payments

• Free accounts receive 5 credits upon registration.
• 1 credit = 1 image at 2K resolution. 4K images cost 2 credits.
• Paid subscriptions renew monthly and include a set number of credits.
• Unused credits do not roll over to the next month.
• Payments are processed by Stripe. All prices are in USD.
• You can cancel your subscription at any time. Access continues until the end of the billing period.
• Refunds are handled on a case-by-case basis. Contact hello@sellpic.ai.

5. Your Content

• You retain all rights to the product photos you upload.
• You grant us a limited license to process your images for the purpose of generating AI outputs.
• You own the AI-generated images created from your uploads.
• You are responsible for ensuring you have the right to use the product photos you upload.
• We do not permanently store your uploaded images after processing.

6. Acceptable Use

You may not use SellPic to:

• Generate illegal, harmful, or deceptive content
• Create images that infringe on others' intellectual property
• Attempt to reverse-engineer, exploit, or abuse the Service
• Circumvent credit limits or rate limits
• Resell access to the Service without permission

7. AI-Generated Content

Images are generated by AI and may not always be perfect. You are responsible for reviewing generated images before using them in product listings. We do not guarantee that AI-generated images will comply with all marketplace guidelines.

8. Availability & Warranties

The Service is provided "as is" without warranty of any kind. We aim for high uptime but cannot guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

9. Liability

To the maximum extent permitted by law, our total liability for any claims arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time by contacting hello@sellpic.ai.

11. Changes

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email.

12. Governing Law

These terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Detmold, Germany.
